Alternative Dispute Resolution for BC Stratas

Finally!  The Civil Resolution Tribunal Act, Bill 44, was passed this year. The Act,  creates an independent body, the Civil Resolution Tribunal, which will provide dispute resolution tools so that strata owners, strata corporations and tenants will have some recourse during disputes other than taking each other to court. The tribunal is expected to be operational by 2014. 


According to the REBGV, the tribunal will deal with disputes between strata property owners and strata corporations, including non-payment of strata fees or fines, unfair actions by the strata corporation and uneven or arbitrary or non-enforcement of strata bylaws such as smoking, noise, pets, parking and rentals. They'll also handle disputes over common property, financial responsibility for repairs and a number of other issues. 


This is a big step forward in terms of accessibility for strata owners and strata corporations. Taking your strata or your strata owner to court is an expensive undertaking and both sides are reluctant to do so. This is a win/win for everyone involved. You can learn more about the tribunal at:
